1. Scope and Subject of Agreement

These Terms of Use (“Terms”) govern the relationship between you (“User”, “you”) and Tasy AI GmbH (“we”, “us”) regarding the use of our AI-powered video creation platform, including AI avatars and voice generation (“Services”). By registering or using our platform, you agree to these Terms.

2. Description of Services

We offer services to create AI-generated videos (including AI avatars and voice generation). A basic version of our services is available for free, while certain features and higher usage levels are available via paid subscriptions or one-time payments. Specific features and content details are outlined on our platform.

You retain full ownership of content created via our platform, subject only to these Terms and any applicable third-party licensing (particularly from ElevenLabs and Sync).

3. Registration and User Accounts

• Registration: A valid email address is required for registration. You must provide accurate and up-to-date information and protect your login credentials.
• Responsibility: Sharing account information with third parties is prohibited. You are solely responsible for all activity under your account.
• Account Suspension/Deletion: We reserve the right to suspend or delete accounts suspected of violating these Terms or applicable law.

4. Free and Paid Services

• Free Plan: A basic version of our services with limited features is provided free of charge.
• Paid Plans (Subscriptions): Additional features or higher usage limits require payment processed through Stripe. Refunds are issued according to applicable law or our refund policy, detailed on our platform.

5. Usage Rules and Prohibited Content

We are committed to maintaining a safe, respectful, and inclusive platform. You agree not to create, upload, or generate any content that:

5.1 Harassment and Discrimination

• Harasses, bullies, intimidates, or threatens any individual or group
• Contains discriminatory language or content based on race, ethnicity, religion, gender, sexual orientation, disability, age, or any other protected characteristic
• Promotes hate speech, violence, or hostility against individuals or groups
• Includes slurs, derogatory language, or offensive terminology targeting any community
• Encourages or incites discrimination or prejudice against any person or group

5.2 Harmful Audio and Video Content

• Contains threatening, abusive, or aggressive language in audio or video form
• Uses AI voice generation to impersonate others without consent for harmful purposes
• Creates deepfake content intended to deceive, manipulate, or harm others
• Generates content that could be used for cyberbullying or online harassment
• Produces audio or video content that promotes self-harm or suicide
• Creates content that sexualizes, exploits, or endangers minors in any way

5.3 Additional Prohibited Content

• Is pornographic, sexually explicit, or contains adult content
• Promotes illegal activities, criminal behavior, or glorifies violence
• Contains political propaganda or misleading political content
• Violates intellectual property rights or other rights of third parties
• Spreads misinformation, false information, or conspiracy theories
• Contains spam, scam content, or fraudulent material
• Includes doxxing or sharing of private personal information without consent
• Misleads users regarding the AI-generated nature of the content

5.4 Content Filtering and Moderation

We are dedicated to preventing the creation and distribution of harmful content through multiple layers of protection:

• Automated Content Filtering: We employ advanced AI-powered content filters that scan text inputs, audio content, and generated videos to detect and block prohibited content before it is processed or created.
• Real-time Monitoring: Our systems continuously monitor content creation processes to identify and prevent the generation of harmful material.
• Manual Review: Flagged content undergoes human review by our moderation team to ensure accuracy and context-appropriate decisions.
• User Reporting: We provide mechanisms for users to report concerning content, which is promptly investigated and addressed.
• Continuous Improvement: We regularly update our filtering systems and policies based on emerging threats and community feedback.

Important Note: While we implement comprehensive filtering measures and continuously work to improve our content moderation systems, we cannot guarantee 100% detection of all prohibited content. We are committed to ongoing efforts to enhance our safety measures and encourage users to report any concerning content they encounter.

Consequences: Violation of these content policies may result in immediate content removal, account suspension, or permanent account termination, depending on the severity and nature of the violation. We reserve the right to report illegal content to appropriate authorities.

6. Content Rights

• User Ownership: You retain complete ownership of all content created on our platform.
• Compliance: You must ensure no third-party rights are violated (e.g., copyrights, personal rights).
• Labeling Requirement: You agree to label AI-generated videos or voices clearly (“This video was created with AI”) if required by law or by us or third-party providers.
• Content Processing: You grant us and our providers (including ElevenLabs and Sync) the right to process your content solely to provide the services (e.g., temporary storage, editing, format conversion).

7. Disclaimer and Limitation of Liability

• AI-Generated Content: Services and AI-generated content are provided “as is” without warranty of accuracy or suitability for any purpose. AI-generated content may be incorrect, incomplete, or misleading.
• Limitation of Liability: We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from using (or inability to use) our services or from erroneous or unlabeled content, except in cases of intentional misconduct or gross negligence.
• Illegal Content: We disclaim all liability for user-generated illegal content. Accounts may be suspended for violating applicable laws.

8. Contract Duration, Termination, and Account Deletion

• Duration: The agreement continues indefinitely.
• Termination by User: You may terminate your account anytime by deleting it or contacting us via email. We may automatically delete accounts inactive for over one year.
• Violation: Violating these Terms can result in immediate suspension or termination of your account without entitlement to account restoration.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Jurisdiction is Bruchsal, unless otherwise mandated by consumer protection laws.

10. Amendments to Terms

We reserve the right to amend these Terms at any time. We will inform you about significant changes via email or platform notifications. If you disagree with changes, you may delete your account and cease using our services.
